Terms of Service

By creating an account or using Silmari (the "Service"), provided by FunnelLabs Inc. ("we," "us," "our"), you agree to these Terms and to our Privacy Policy and AI Disclosure & Safety Notice, which are incorporated by reference. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service. By using it, you represent and warrant that you are 18 or older.

Silmari is a narrative- and story-driven AI entertainment service. It provides persona-based fictional character chat for entertainment purposes only. The characters are fictional personas for interactive storytelling. The Service is not an "AI companion," emotional-support tool, or substitute for human relationships, friendship, or care. All content is generated by artificial intelligence and is not professional advice. We do not provide medical, psychological, mental-health, companionship, counseling, legal, or financial services. Do not rely on the Service for important decisions; consult a qualified licensed professional where appropriate.

You are interacting with an artificial-intelligence system, not a human being. AI-generated content may be inaccurate, incomplete, or misleading, and you are responsible for how you use it. Full details, including our self-harm safety protocol, are in our AI Disclosure & Safety Notice.

You are responsible for safeguarding your account and credentials and for all activity under your account. You must provide accurate information and keep it current. Notify us immediately of any unauthorized use.

Some features require a paid subscription or a one-time / credit purchase, billed in USD through our payment provider (merchant of record).

Subscriptions auto-renew for successive periods at the then-current price unless you cancel at least 24 hours before the renewal date.

You may cancel at any time through your account settings using the same ease as sign-up ("click to cancel"). Cancellation takes effect at the end of the current billing period.

We provide renewal and price-change reminders where required by law (e.g., the California Automatic Renewal Law).

Except where required by law, fees are non-refundable once a digital result is generated or access is granted. EEA/UK consumers may have a statutory 14-day withdrawal right; by purchasing and requesting immediate delivery of digital content, you acknowledge you may lose that withdrawal right once delivery begins. Credits and virtual items have no cash value and are non-transferable.

You agree not to: use the Service if under 18; misuse, reverse-engineer, decompile, scrape, or overload the Service; attempt to generate sexual content involving minors, exploitative, hateful, harassing, or illegal content; impersonate others; infringe intellectual-property rights; or violate any applicable law. We may moderate, restrict, suspend, or terminate accounts for violations.

We and our licensors own the Service, its software, characters, and generated formats. You retain rights to the inputs you provide and grant us a worldwide, non-exclusive license to process them solely to operate, secure, and improve the Service. You are responsible for your inputs and represent that you have the right to provide them.

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, and our total aggregate liability is limited to the greater of the amount you paid to us in the 12 months before the event giving rise to the claim or USD 100.

You agree to indemnify and hold us harmless from claims, damages, and expenses arising from your misuse of the Service or violation of these Terms.

PLEASE READ CAREFULLY — THIS AFFECTS YOUR LEGAL RIGHTS. Any dispute relating to the Service will be resolved by binding individual arbitration under the Federal Arbitration Act (FAA), not in court, except that either party may bring qualifying claims in small-claims court. You and we waive any right to a jury trial and to participate in a class, collective, or representative action.

You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@funnellabs.app.

For US users, these Terms are governed by the laws of the State of California, without regard to conflict-of-law rules (arbitration is governed by the FAA). For users outside the US, mandatory local consumer-protection rights are unaffected.

We may update these Terms; we will notify you of material changes and update the "Last updated" date. We may suspend or terminate the Service or your access for violations or legal reasons. You may stop using the Service at any time.
